General Terms and Conditions for UK customers

FOREWORD

These Terms and Conditions ("T&Cs" or "Agreement") constitute and govern the contractual relationship between the parties, Probe Investments Ltd hereinafter referred to as "Energy", and You, as the user, hereinafter referred to as "CLIENT", "You" or "Player".

DEFINITIONS

The following words and terms, should be interpreted as follows, unless, the context clearly implies otherwise.

"Registration Form" means the form to be filled in by the CLIENT to open a User Account.

"Game" refers any gaming activity presented by Energy on its Internet Sites for the benefit of the Users and as approved by the Regulatory Authority.

"Internet Site", "Website" or "Site" shall mean the Internet Website energycasino.com, and all other sites connected to it and accessible through links.

"Login and Password" means the login and password details that are chosen by a CLIENT upon registering with the online Casino.

"Regulatory Authority" means the Gambling Commission of Great Britain (Victoria Square House, Victoria Square, Birmingham, B2 4BP, email: info@gamblingcommission.gov.uk), which is the regulator of remote gaming operation for the gambling Services provided to customer located in the United Kingdom.

"Service" shall include all Energy Services and game offer activities related to it and listed on energycasino.com including but not limited to online casino services.

"Live Casino" or "Online Casino" is online version of traditional casino, enabling users to play and wager on casino games through the Internet in real time.

"Software" means the software licensed by us including all programs and databases and any other derived content whether accessible or otherwise used by the CLIENT through the Internet WEBSITE allowing the CLIENT to participate in the online casino.

"Us, We" or "Energy" mean EnergyCasino or Probe Investments Limited.

"User Account", "Player Account", "Gaming Account" or "Account" mean a personal account opened by an individual and maintained by Energy as to allow this person to participate in the online casino.

"You", "CLIENT", "Player", "User" or "Account Holder" mean the user of the Service and of the software accessible through the Internet Site and having a contractual relationship with Energy.

"Money Player" means individuals over 18 years of age, who participate in games for money (stake real money "Games for money"). CLIENTS can participate in games as "Test Player" without wagering money or as "Money Player" wagering real money.

"Fun Games" or "Games for fun" mean Games as defined in this Agreement but that are offered for limited gameplay in a special Game mode which does not involve payment from the CLIENT to the Operator. The sole purpose of this mode (games for fun) is to offer the possibility for the CLIENT ("Test Player") to try out the Games offered before staking real money.

1. GENERAL

a. "Energy" in these Terms and Conditions refers to Probe Investments Ltd, a company incorporated in Malta, having the following registered address:

b. The term "CLIENT" references any individual or entity that expressly or impliedly agrees to all terms and conditions of Energy by opening an account and placing bets on games on Energy’s WEBSITE.

c. All CLIENTS accessing the Energy WEBSITE agree to abide by the following terms and conditions governing the use of its Services (the "Agreement").

d. This Agreement describes the terms, conditions and risks applicable to the CLIENT using of Energy Services available under the domain of energycasino.com (the "SITE"). If the CLIENT has any questions regarding this Agreement, shall contact Customer Support.

e. The CLIENT must read, agree with and accept all of the terms and conditions contained in this Agreement without modifications, which include those terms and conditions expressly set forth below and those incorporated by reference, before the CLIENT may become an active, registered CLIENT of Energy. By continuing to access or use the SITE, the CLIENT agrees to follow the terms and conditions of this Agreement.

f. This Agreement is effective upon acceptance of the registration for newly registering CLIENTS by checking the box "I am 18 years old or over, and I have read and accepted the Terms and Conditions and Privacy Policy" and clicking "Register" button in the course of the registration on the SITES. The CLIENT commits to comply with the Terms and Conditions of the WEBSITE. If the CLIENT does not agree to be bound by the terms and conditions of this Agreement, and does not use or access our WEBSITES after registering, the CLIENT must inform us in writing immediately.

g. This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales and the Gambling Commission Licence conditions and codes of practice (LCCP), excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under this Agreement will be brought exclusively in courts located in England, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

h. Energy will not be liable in any way to any persons in the event of force majeure, or for the act of any government or legal authority. In the event that any provision in this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

i. Failure of a party to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

j. Energy may assign this Agreement or any rights and/or obligations hereunder without the CLIENT’s consent.

k. Energy may revise the terms of this Agreement from time to time by posting the amended terms on the WEBSITE. Before any material change takes place, Energy will reach customers by email or inbox message in advance to ensure customers have enough time to read through amendments that might affect their use of service. In case of modification of these T&Cs, on logging into his/her account with Energy, a pop-up box will inform the CLIENT that the T&Cs have been updated. The CLIENT will be requested to agree with the updated T&Cs before they continue to use the Service. If the CLIENT does not agree to be bound by the changes to the terms and conditions of this Agreement, the CLIENT account will be closed.

l. Energy is operated by Probe Investments Limited which is registered under the laws of the European Union member state of Malta. It has registration number C51749 with trading address at Suite 109, Level 4, Sir William Reid Street, Gzira, GZR1033, Malta.

m. Should any discrepancy between the T&Cs in the English language version and the version in any other language arise, the English version will supersede. The prevailing language in case of interpretation will be the ENGLISH language. All language versions in the Terms and Conditions will reflect the same principles.

2. Online Services Agreement

This Agreement is made by and between Energy and the CLIENT. This Agreement applies to the Energy WEBSITE, including its electronic content and/or software currently contained on the WEBSITE that supplies the CLIENT with the games Services offered by Energy.

Energy reserves the right to impose certain conditions (beyond those detailed in Clause 3,4,5,6,7) on the admission of CLIENTS to the games (e.g. minimum number of completed games, verification of transacted payments) and to extend or change the Services on the WEBSITE at any time.

3. Membership Eligibility

a. The Services are available to and may only be used by individuals who can form legally binding contracts under the law applicable to their country of domicile. It is the CLIENT’s responsibility to ensure that their betting activity is legal.

b. Services are not available to persons under the age of 18 ("Minors"). If the CLIENT is a Minor, the CLIENT may not use this service. Participation in the games for money, as well as in the games that are free-to-play is exclusively reserved for individuals over 18 years of age. Please bear in mind that it is a criminal offence to gamble when you are under the age of 18.

c. Energy is entitled to require CLIENT to provide proof of age and to disable CLIENT’s activity if it has reasons to believe that the minimum age requirement is not fulfilled.

d. Energy Services are not available to customers residing in regions, where Energy’s operations would be illegal to use with local laws (including but not limited to the United States) and Energy reserves the right to refuse and / or cancel Services if it has sole grounds to believe of CLIENT’s misconduct.

4. Registration Information

a. In order to participate in the games as a Player the User must complete the registration form on the WEBSITE energycasino.com and therewith open a "Player Account". The User must fill in the registration form provided by Energy which shall at least include the following details:

(I) the customer’s identity. The CLIENT warrants to, provide true, accurate, current and complete information regarding identity during the registration process. Any false information or impersonation of any person or entity, misrepresentation regarding any affiliation with another person, entity or association, use of false headers or other acts or omissions to conceal one’s identity from Energy for any purpose will be prosecuted under the fullest extent of the law. A CLIENT accessing Energy Services will be asked to provide valid subsisting verification of identity and relevant information.

(II) date of Birth. The CLIENT assures Energy that he/she is over 18 years of age. No person under the age of 18 may be registered as a player, as it is a criminal offence to gamble underage.

(III) the CLIENT’s place of residence. Please note that the CLIENT will be asked to prove his/her place of residence by providing a utility bill or a bank statement that was issued within the last three months.
For Energy to comply with applicable laws and regulations in the United Kingdom, the CLIENT’S personal details supplied at the registration stage (identity, date of birth and place of residence) must be confirmed through verification checks before the CLIENT is allowed to:

a. deposit funds into an account;

b. access any free-to-play games;

c. or gamble with their own money or Energy bonus funds.

(IV) the customer’s valid email address and mobile number.

(V) personal and confidential username ("Pseudonym", "Nickname"). The Username must be unique and clearly identifiable. Offensive or indecent names are not allowed. Further prohibited are usernames that contain or allude to an Internet link or account names, which allude to certain rights of the User (e.g. the term "administrator" is reserved for Energy). We reserve the right to suspend accounts with an unacceptable Username. Accounts can be reactivated as soon as suitable and acceptable alternative has been chosen.

(VI) password. The User is advised to choose a strong and non-predictable password for security and is responsible for ensuring the secrecy of such password.

b. During the registration process, the CLIENT must provide Energy with valid identification, including but not limited to the address, contact email and mobile number.

c. You shall ensure that registration details are kept up-to-date and shall make any necessary changes of name, address or email address on the Energy website without undue delay. You are responsible for informing us immediately regarding any changes to your personal information.

d. If your address and country of residence no longer correspond to the location you indicated when registering your account, and you now fall under another legal jurisdiction, you must close your account and register again with the new address.

e. If during user verification it becomes apparent that the information provided by you is false or inaccurate, Energy is entitled to suspend or terminate your account and retain any winnings including cases that involve self-excluded accounts.

f. When the customer submits his first request for withdrawal, details of his personal bank account or any other payment method available and acceptable for such withdrawal should be provided to Energy.

g. The CLIENT is responsible for securing the CLIENT Username and Password for their account with Energy. Energy holds no responsibility for any damage caused due to any act or omission of the CLIENT may cause inappropriate or irregular use of their Account.

h. The CLIENT must register personally and not on behalf of someone else.

i. The CLIENT is not allowed to register if he/she is already registered on Energy WEBSITES with an account. Only one account per person is allowed. Holding more than one Account is known as "multi-accounting" and is strictly forbidden and directly deemed to be fraudulent regardless of whether the other Account is registered under the user’s own details, other Energy users’ details, third parties’ details (other than Energy users) or false details. Energy reserves the right to close any CLIENT account, at any time. If we consider that multiple Accounts have been opened in genuine error, the unused balances will be returned back to the customer. If Energy has a reasonable grounds to believe that fraud has been committed, Energy reserves the right to cancel any related transaction, any bonus or any other promotion without prejudice to any other action or redress we might avail ourselves of.

j. Energy will treat with care the information the CLIENT entrusted to it, in accordance with the disclosures provided during the registration process and present in the Privacy Policy.

k. It is prohibited for CLIENTS to sell, transfer and/or acquire accounts to/from other CLIENTS. Funds can only be remitted to the same account from where they originated at the deposit stage.

l. The CLIENT is prohibited from depositing money using a debit card, bank accounts and any other payment accounts and solutions of which he/she is not a legally authorised owner or joint account holder.

m. Making deposits by the CLIENT into an account for any reason other than participating in games, particular illegal purposes (e.g. money laundering or financing terrorism) is not allowed and shall be deemed as a criminal offence; depositing money originated from criminal and/or other unauthorised activities is also prohibited and illegal.

n. If the CLIENT breaches any provision of these Terms and Conditions or we have a reasonable ground to suspect that the CLIENT breached them, we reserve the right to decline reopening, suspension or closure his/her Account, or withhold payment of any winnings.

o. The registration and set up of a gaming account are free of charge.

p. There is no general right to registration and participation in the games.

q. The CLIENT declares that he/she is not currently or have never been diagnosed as a compulsive gambler and do not have any mental issues which might affect the CLIENT’s judgement or decision-making.

5. Password Security

a. The CLIENT is advised to choose a strong and non-predictable password for the purpose of account security. The CLIENT is also responsible for ensuring the safe-keeping of said password.

b. Gameplay on the WEBSITE using a Player’s Username and security details will be regarded as valid, irrespective of who participates in the Game. If any concerns regarding the secrecy of such details arise, the CLIENT should notify Energy immediately and new security details will be created - any future transactions under the previous details will be flagged and considered void.

c. Energy is in no way responsible for the possible access to a CLIENT's Account, by a third party and will not be held responsible for any losses incurred, due to the illicit use of a CLIENT's password by a third party. Including, but not limited to; unauthorized access, and/or any transaction in which the name and password of a CLIENT was registered correctly.

6. Legal Restrictions

a. The CLIENT confirms the understanding of the local regional laws regarding online gambling and it is CLIENT’s obligation alone to ensure compliance with any law, regulation or directive, relevant to CLIENT's region of residence. The ability to access the Energy WEBSITE does not necessarily mean that the use of Energy Services, and/or the CLIENT's activities through it, are legal under the laws, regulations or directives relevant to the CLIENT's region of residence.

b. The CLIENT understands and accepts that Energy is unable to provide them with any legal advice or assurances and that it is the CLIENT’s sole responsibility to ensure that at all times they comply with the laws that govern them and that they have the complete legal right to play the Games. Any participation in the Games is at their sole discretion and risk. By playing the Games, they acknowledge that they do not find the Games or Services to be offensive, objectionable, unfair, or indecent in any way.

c. The CLIENT guarantees at all times not to be a resident of any of the "Excluded Countries" including, but not limited to: Australia, Belgium, Curacao, Czech Republic, Democratic People's Republic of Korea, Ethiopia, France (including all french overseas territories), Hong Kong, Iran, Iraq, Ireland, Israel, Italy, Latvia, Lithuania, Pakistan, Romania, Serbia, Slovakia, Spain, Sri Lanka, Switzerland, Syria, Trinidad & Tobago, Turkey, Tunisia, Ukraine, United States, Yemen and/or restricted by limited legal capacity.

d. Energy does not intend for its WEBSITES to be used for any other purposes by the CLIENT present in countries in which such activities are illegal. Energy’s WEBSITES do not constitute an offer, solicitation or invitation by Energy for the use of the Games or any other Services in any jurisdiction in which such activities are prohibited by law.

e. CLIENTS shall not treat the licensee as a financial institution nor expect interest on their deposits.

f. Energy reserves the right to close the Account permanently and confiscate any potential winnings, should the CLIENT violate this condition and register from any of the currently Excluded Countries.

7. Live Casino

a. When playing Live Casino the CLIENT is allowed to play only at one table at a time. Playing at multiple tables simultaneously is strictly forbidden.

b. All live casino games tables and chat rooms are monitored and moderated by employees of the corresponding live casino provider. In case of any concerns, a CLIENT can contact the Live Casino dealer at any time. However, using abusive or offensive language, making matrimonial offers, sexual comments or threats is strictly prohibited.

c. In the case of a croupier’s mistake, the video footage of the contested hand will be reviewed by live casino manager. The management’s decision is decisive. If it is decided that a mistake was made by the provider, all contested stakes will be refunded to the Player in that particular hand. Should a CLIENT find Energy's decision unsatisfactory, they can seek an alternate dispute arbitration, whose decision will be deemed final.

d. Live Casino games can be played for real money only. Bonus Money cannot be used. The operator prohibits to place bets explicitly and/or persistently with money and/or bonus money, where the chances of winning equal or more than 70% (sure bet). The operator reserves the right to block the CLIENT´s account and prevent and/or withhold any winnings or payout obtained by the violation of the platform’s rules and/or by any other violations of the terms and conditions.

e. Games provided by Evolution are not available for players residing in: Manitoba, British Columbia, Quebec and Ontario.

f. The above Live Casino rules shall also apply as a supplement to the General Terms and Conditions of Energy.

8. Limited Use

a. Energy grants the CLIENT a non-exclusive, non-transferable and limited to personal use, regarding the access to the WEBSITE (the "License"). The use of the WEBSITE is conditioned on the continued CLIENT compliance with the terms and conditions of this Agreement.

b. The CLIENT agrees not to resell marketing materials provided to them by Energy nor permit secured access of the WEBSITE to others, and not to copy any materials appearing on the WEBSITE for resale or for any other purpose to others without the prior written consent of Energy.

c. The CLIENT shall be responsible and bound by any unauthorized use of the WEBSITE, made in breach of this section.

d. The CLIENT agrees to use the information received from the information systems of Energy for the sole purpose of executing transactions solely within the WEBSITE.

e. The CLIENT further agrees not to use any electronic communication feature of a Service on the WEBSITE for any purpose that is unlawful, tortuous, abusive, intrusive, harassing, libelous, defamatory, embarrassing, obscene, threatening or hateful or that may breach another CLIENT’S privacy.

f. The License granted under this Agreement will terminate if Energy believes that any information provided by the CLIENT, including the CLIENT email address, is no longer current or accurate, or if the CLIENT fails to otherwise comply with any term or condition of this Agreement and all rules and guidelines for each service, or Energy establishes that the CLIENT has in any way abused Energy’s games and/or Services. Upon clear notification of such violation, the CLIENT agrees to cease accessing Services. The CLIENT agrees that Energy may terminate the CLIENT's access to any or all Services, close the CLIENT's open transactions, remove and discard any information or content with its Service due to the breach of the provision of this Agreement.

9. Misconduct

a. CLIENT misconduct by a CLIENT is forbidden on the WEBSITE. A CLIENT’s behaviour is deemed as a violation of these Terms and Conditions, whenever, but not exclusively, to a CLIENT:

(I) intentionally providing inaccurate or incomplete information;

(II) attempting to manipulate the result of games through concerted practices, alterations of the program or in any other undue way;

(III) deliberately causing malfunctions or defects of the WEBSITE in order to undermine the integrity of the game;

(IV) sets up more than one account per person or colludes with other players, in any way, in an attempt to take advantage or undermine the outcome of a game(s);

(V) using abusive or offensive language in email messages and/or during a live chat, makes matrimonial offers, pornographic references or sexual comments, sends spam, threatening messages, uses verbal abuse or slurs towards Energy and its employees. Any violation of this policy will result in the end of the conversation and suspension of player’s account for an indefinite period of time.

b. The CLIENT will not decompile or attempt to decompile the software on Energy’s WEBSITE or develop software that interferes with the Client-Server-Communication software used on its WEBSITE.

c. The use of any software program which facilitates artificial intelligence is strictly prohibited. Prohibited software may include software which Energy believes allows a player to cheat or gives a player an unjust advantage while wagering on the WEBSITE. Energy reserves the right to take action in order to detect and prevent the use of such software by Players. Energy reserves the right to freeze a relevant Player’s account for a period of at least six (6) months, to confiscate any funds in that account and/or to suspend the Player from using the Services of Energy, should Energy identify or suspect beyond reasonable doubt the use of such prohibited programs.

d. In the event of misconduct by a CLIENT, Energy is entitled to immediately terminate the Agreement with the CLIENT and exclude him from further use of the WEBSITE. Furthermore, Energy is entitled to interrupt and terminate on-going game activity, and the CLIENT’s account with or without prior notice and to retain winnings achieved through misconduct until clarification of the situation is reached.

10. Account Cancellation

a. Energy reserves the right to refuse or cancel the services, and/or refuse to distribute profits and retain the remaining balance for any legitimate reason, including but not limited to:

• any instance when Energy has cause to believe that a person’s activities on the site may be illegal;

• any instance where Energy may suffer any fiscal, regulatory or pecuniary disadvantage by virtue of the person’s activities;

• any instance where one or more transactions on the site are judged by Energy to have been performed in violation of this agreement.

b. Energy prohibits CLIENT collusion and takes measures to prohibit use of devices, such as robots, that distort normal game play.

c. Energy reserves the right to terminate events or games without prior notice, whenever it deems necessary and / or due to errors in the software or games, which cause games to malfunction or work incorrectly.

d. Energy reserves the right to terminate an Account and retain all the remaining funds in the Account where Energy has reasonable belief that a player committed/attempted to commit/ was involved in proceedings leading towards potential fraudulent activity or otherwise advised on fraudulent activity to third-party-player/s or hacked or accessed otherwise unlawfully third-party players’ Account for the purpose of alleged fraudulent activity or otherwise. Such activity could involve inter alia, organised betting, use of stolen or falsified debit cards or Account numbers, forgery, collusion and submission of data or documents which are forged, stolen or otherwise misappropriated.

e. Energy reserves the right to terminate an account and retain all remaining funds due to irregular play. Irregular play can be defined as, but not limited to:

(I) Delaying any game round in any game, including free spins features and bonus features, to a time when you have no more wagering requirement; and/or performing new deposit(s) while free spins features or bonus features are still available in a game.

(II) While playing a game, a "free spin" or "bonus" feature is initiated with bonus or cash funds; the player then leaves the feature by closing the game and moving to another. The player then returns to the original game to complete the feature at a later time in circumstances such as after the bonus money has been forfeited or lost or wagering requirements met and converted to cash.

(III) Bonus or cash funds are used purely to progress through bonus stages (for example, collecting 9 out of 10 coins to reach a feature) and then the final stage/s (for example, the final coin to reach 10 out of 10 coins) completed with cash bets when bonus funds have been forfeited, lost, or wagering requirements met and converted to cash. 

(IV) Leaving large bets on a table, for example, in blackjack, and then returning at a later time to complete the bet in circumstances such as after the bonus money has been forfeited or lost or wagering requirements met and converted to cash.

(V) Depositing and withdrawing funds soon after, for example, depositing funds to receive free spins, wagering your deposit just over 1x your deposit value, initiating a withdrawal and then activating your free spins.

(VI) Whether known or unknown to us, the player takes advantage of any software or system bug, loophole, fault, error, or failure regarding any game.

(VII) Whenever we detect that you have been using card counting techniques or have been informed by the game supplier.

f. Energy reserves the right to terminate an account and retain all remaining funds in cases where our payment providers or game or sports suppliers have identified your account with bonus abuse or fraud.

11. Aborted or Interrupted Games

a. In the event that any information is incorrectly published on the WEBSITE, Energy will take remedial action in order to rectify and amend the data in the system so as to reflect the correct information. Any winnings that are affected by the publishing of incorrect information will also be amended accordingly.

b. In the event of a malfunctioned game for any reason whatsoever, all players’ transactions are always accurately logged on our systems, therefore, we always have access to gameplay logs. Kindly contact customer care team for any related queries via email on support@energycasino.com.

c. Energy reserve the right to correct or declare results void with hindsight, if the result of the game was caused by a technical default, fraudulent behaviour of a CLIENT or through a fake wager. Energy reserves the right to recall any payment made in error.

12. Cash Gaming Mode ("Games for money")

a. Each eligible CLIENT (refer to Section - 3. Membership Eligibility) can play games using cash, after opening an account and successfully depositing funds to Player’s account.

b. Participation in the Cash Games with real stakes requires the CLIENT to deposit cash to his gaming account as described below.

13. Test Gaming Mode ("Games for fun")

a. After an account is established and the CLIENT is able to successfully log into his gaming account with Energy, a certain amount (as defined by Energy) of virtual Fun Money is credited to the Player’s account. This allows the CLIENT to test the games on the WEBSITE.

b. There is no claim, substitution or conversion for virtual Fun Money, should the CLIENT win. .

c. Withdrawal of this credit or transferring the Fun Money as real money is not possible.

d. The credit of virtual Fun Money is recharged automatically every day and cannot be purchased by the CLIENT with cash.

14. Deposits

a. CLIENT accounts can be funded (by transfer of money to Energy’s account) by utilising a number of available deposit methods. Further information about deposit methods can be found in the Deposit section of the WEBSITE.

b. All payments into the Account must be from a payment source where the CLIENT is the primary account holder.

c. You acknowledge that only personal cards/accounts are authorized at Energy website. Business and company accounts cannot be used to deposit.

d. Energy does not guarantee that all methods of payment are available at all times, but will do its utmost to provide customers with continuous service.

e. Energy reserves the right to impose certain conditions on the use of particular payment methods, in such cases, but not limited to; if enforced by payment providers requirements, or regulatory requirements in connection with the Social Responsibility Code of the license, or if connected to the suspicious activity of a particular player. Energy also has the right to change the payment methods available, but only if such payment method is discontinued by the legal contract binding Energy and the 3rd party payment provider in question.

f. Self-deposit limits can be set by the player in the ‘Responsible Gaming’ section.

h. As per applicable laws and regulatory requirements, Energy is required to verify the CLIENT’s details: - name, address and date of birth - before the CLIENT is able to gamble. In order to match details, Energy uses information supplied by the 3rd party electronic provider. In cases where the data cannot be matched, Energy will not allow the customer to gamble unless the account is fully verified by the finance department. Energy reserves the right to request further information and documentation to conduct the manual checks.

i. To verify the player's identity, the following documentation is accepted: driving license, passport or EEA/EU member state identity card. Please be advised that all aforementioned documents must be valid and submitted as coloured scans; copies in black and white are not accepted.

To verify the player's place of residence, the following documents will be accepted as proof of address (POA): utility bill (gas, electric, satellite television, landline phone bill) or bank statements issued within the last three months. A mobile phone bill will not be accepted. Such personal information enables Energy to verify that the data given during registration corresponds with data on the documentation.

j. Energy reserves the right to request a photo of the account holder with a valid ID and a note specifying the date and time.

15. Additional Verification Checks

a. Energy reserves the right to request additional information and documentation from any client, if such evidence is required to fulfil other legal obligations. From a compliance perspective further documentation may be necessary later in the relationship. For instance, Energy may request additional documentation in the following circumstances:

1) Via analysis of the account, there is significant suspicion of possible money laundering (high risk triggers or patterns can be identified)

2) There is an evident connection that enables Energy to connect multiple accounts to the CLIENT (called multi accounting or bonus abuse) or to link CLIENTS to accounts that had previously self-excluded. This could be established via measures such as similar address, same IP or other connections observed through data supplied by the 3rd party organisations that Energy cooperates with)

3) There is a strong suspicion of Fraud or fraudulent activity such as suspicious deposit pattern, frequency and/or highly unusual pattern of play, breaching of closed loop policy or where the customer used 3rd party payment method

b. Please be advised that Energy will always request further documentation on a risk-sensitive basis. This approach remains in line with published guidance on money laundering that Energy is fully committed to.

c. As part of the additional verification process, Energy reserves the right to request the following information:

1) An image of both sides of the debit card used to deposit, in case a deposit comes from a non 3D secure scheme (additional fraud prevention system processing) or if a customer is processing large or multiple transactions. In order to reflect the best security practices, the CLIENT will always be asked to hide the CVV number and wipe out certain card numbers. In all circumstances the card copy will only be accepted if the back is accurately signed. In a small number of cases we might require additional proof of residence or transaction in PDF format;

2) A copy of a bank statement for the account that will be used to withdraw winnings to, in case they were originated from a non-deposit bonus;

3) Tax return or tax declaration;

4) A photo of you with your ID;

5) Identity verification over the phone;

6) A notarised copy of the document(s);

7) A proof of a particular, or number of deposits that may seem of high risk in relation to money laundering;

8) A declaration that will confirm CLIENT’S Source of Wealth (SOW);

9) A proof of Source of Funds (SOF) that may be in the form of:

i) Proof of earnings: Payslip/Director remuneration/Dividends/Pension

ii) A bank statement/savings account that clearly shows consistent incoming values from an identifiable source

iii) A Trust deed clearly showing a consistent entitlement to funds

iiii) Dated proof of an award/payment made to the CLIENT from 3rd parties

Other clear evidence that would support "affordability" in relation to CLIENT’s business with Energy.

d. Energy reserves the right to block your deposits or game play while conducting additional but necessary verification checks. Energy will do the utmost to inform the customer about the process via service email and to conclude these checks as soon as possible.

e. Please be advised that Energy holds the right to withhold any funds until the verification process is duly completed and deemed satisfactory on our end.

16. Withdrawals

a. Information relating to withdrawal methods is included in the Withdrawal section of the WEBSITE.

b. A request for withdrawal cannot be made while the CLIENT is involved in an ongoing gaming session.

c. The CLIENT may withdraw any withdrawable funds from account at any time. 'Withdrawable funds' means all winnings from wagers made with your deposits, and excludes any funds that are subject to a restriction (including wagering restrictions or other promotional play restrictions). The right to withdraw these funds is subject to our regulatory obligations being fulfilled (including source of funds and additional verification checks).

d. Withdrawals can only be paid-out to the same account and payment method from which the CLIENT’s deposits were originated. In such cases where a payment method cannot be used for a withdrawal (for instance paysafecard), the CLIENT'S withdrawal must be paid to their bank account. By following a “closed-loop” policy (ensuring that pay-outs are made back to the same method as the inbound funds originated) Energy complies with “The EU Anti-Money Laundering Directive.” However, there are some occasions where this closed-loop system is impossible to enforce. Whilst ensuring compliance with the “The EU Anti-Money Laundering Directive,” Energy is also obligated to ensure our CLIENTS’ needs are served. Furthermore, on occasion, technical and /or policy reasons beyond our control may dictate that some pay-outs cannot be made in this fashion. In these cases Energy endeavours, via required measures and beyond, to verify an alternative account owned by the individual CLIENT. The finance department of Energy makes the final decision as to whether a payment outside of the “closed-loop” policy will be performed.

e. Once a withdrawal request is submitted it can take Energy up to three (3) business days to process the request. However, Energy strives to process withdrawal requests immediately.

f. Withdrawals of winnings, or parts thereof, will be paid out upon request by the player. Please note that only the first withdrawal of the week is free of charge. A fixed fee of €5 (or currency equivalent) will be applied to all subsequent requested withdrawals during the same week. The minimum withdrawal amount may range between £10 and £20 (or currency equivalent), depending on the player’s jurisdiction and selected currency. In case of account closure, the player has the right to withdraw the balance in full, regardless of the amount. The maximum withdrawal amount is determined by the chosen payment method.

g. Energy attaches great importance to the security of your funds, therefore the maximum withdrawal amount per day (24 hours) is £5,000. This does not apply to progressive jackpots. To protect CLIENT’s funds from unauthorized outflow, all withdrawals above £5,000 per day will be subject to additional checks to verify the person requesting the withdrawal.

h. Please be informed that there is a three per cent (3%) administrative charge to cover the payment provider fee, which will be applied for withdrawal requests referring to amounts deposited with Energy that have not been used at least once for playing casino games or sports bets. Such pay-outs have to be assessed and confirmed by the finance department before being approved.

17. Protection of CLIENT'S funds

Energy is required to inform customers about how funds are being held on their accounts, and the extent to which such funds are protected in the event of insolvency. In accordance with the Gambling Commission's rating system, Energy offers not protected segregation in relation to the funds held on player accounts. This means that a customer's funds are kept in accounts separate from business accounts but would form a part of the assets of the business, in the event of insolvency. 18. Bonus Policy

a. Energy may, from time to time, offer our players bonuses, which will be credited by Energy into their accounts. Bonuses being offered and their details of crediting will be available in the Bonus / Promotions section on the WEBSITE. The Bonus amount is determined by Energy and CLIENTS have no general entitlement to receive Bonus.

b. Each individual promotion will come with its own set of specific relevant terms and conditions (the “Significant Terms”) in addition to Standard Bonus Terms and Conditions, the CLIENT should therefore read ‘Standard Promo Terms’ in combination with the applicable Significant Terms for any competition, bonus or promotion (referred to as a “promotion” or “bonus” interchangeably) they wish to enter. 19. Limited Liability

a. The games and Services offered on the WEBSITE are only available to CLIENTS within the scope of the current state of technology used. Energy provides no guarantee for the uninterrupted availability or the serviceability of the Services and games offered.

b. Energy endeavours to provide steady Services on the WEBSITE. However, Energy assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction or unauthorised access to, or alteration of, the WEBSITE or Services.

c. Energy is not responsible for any issues or technical malfunction of any telephone network or lines, online computer systems, servers or providers, hardware, software, failure due to technical or internet bandwidth problems or on any of it’s WEBSITES or Services.

d. Energy accepts no liability for any interruption of games or WEBSITE downtime. It is not liable for any errors contained in any game, nor is it Energy’s duty to correct them – Energy is not liable for any damage caused as a result. Furthermore, Energy assumes no liability for the existence of or damage caused by viruses or other damaging components on the WEBSITE or the corresponding server, which could lead to damage to the computer hardware and/or software of the User. For the avoidance of doubt, all winnings from bets, stakes or wagers placed on any games which contains an error shall be voided and Energy shall only be responsible to return the respective bet, stake or wager placed back to the CLIENT.

e. Energy is not liable for damages caused by user error or software malfunction, including but not limited to: errors in the calculation and distribution of winnings, incompleteness or inaccuracy of data resulting from user error, malfunctions related to the underlying mechanics and algorithms of a game or other similar circumstances. 

Any winnings or rewards obtained as a result of such errors, malfunctions or related circumstances are Erroneous Winnings. If an error or malfunction is detected, Energy reserves the right to void any winnings or associated rewards; the wagered amount will be refunded. If you withdraw Erroneous Winnings, you will be liable to repay the entire sum; otherwise, the amount will be deducted from any other sums that we may owe you. 

Energy may correct obvious mistakes, such as errors related to the player’s identity. Energy also reserves the right to limit or refuse wagers due to any errors, software malfunctions or similar circumstances. 

f. To the maximum extent permitted by the applicable law, under no circumstances shall Energy be responsible for any loss or damage resulting from the use of the WEBSITE or Services, from any content posted on or through the WEBSITE or Services, or from the conduct of any users of the WEBSITE or Services, whether online or offline.

g. Under no circumstance shall Energy or any of its directors or employees be liable to the CLIENT for any damages whatsoever, including and without limitation to indirect, incidental or any type of consequential damages, which may arise from, or in connection with a CLIENTS’ use of the WEBSITE or Services, including but not limited to the quality, accuracy or utility of the information provided.

h. Energy is not liable for damages of any kind that are caused by the undue use of the account by the Player or third parties.

i. Energy is not liable for the loss of winnings caused by interrupted games.

j. Simultaneous play on two or more slots is not permitted. Energy will block the functionality which facilitates playing multiple slot games at the same time. Intentionally bypassing this functionality may incur losses that Energy will not be liable for.

k. Energy shall in no event, nor under any circumstances, be liable for any damages or losses that are deemed or alleged to have resulted from or caused by its Internet WEBSITE or its content, including and without limitation to any delays or interruptions in operation or transmission, communications line failure, any person's use or misuse of the Internet WEBSITE or its content, or any errors or omissions in the content.

l. In case of infringement of the Terms and Conditions of the WEBSITE by the User, the User shall indemnify Energy for any claims by third parties and bear any losses, costs or damages resulting thereof.

m. Energy shall not be held responsible for any typing, technical or human error in the operation of the products offered by Energy or in the operation of the Services. In the event of any error, Energy reserves the right to either void any affected bets or to correct the error. Where a correction by Energy changes the terms of a bet, you will be given an opportunity to accept the revised terms prior to the bet being deemed valid.

n. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction, and under no circumstances shall Energy’s cumulative liability to the CLIENT exceed the amount of money the CLIENT transferred or deposited in to the CLIENT’s account on the WEBSITE in relation to the transaction giving rise to such liability.

20. Anti-Money Laundering Procedures

a. All licence providers based in Europe are subject to the European Union’s AML Directive, which requires all entities dealing with financial transactions to verify the legitimacy of funds being used to gamble.

b. No person shall abuse this WEBSITE for the purpose of money laundering. Energy may employ best-practice anti-money laundering (AML) procedures. Energy is responsible for employing and maintaining various anti-money laundering (AML) best practices and procedures, therefore all transactions regardless of the amount must remain under constant monitoring.

c. Energy reserves the right to refuse to do business with, to discontinue to do business with, and to reverse the transactions of, CLIENTS who do not accept or conform to the following AML requirements and policies and to deny acceptance of any transactions from CLIENTS who do not respect and adhere to the following AML requirements:

(I) Winnings will only be paid to the individual who initially registered to open a live account and specifically only to the originating debit card or account on record;

(II) When a CLIENT funds an account by means of debit card deposits, winnings will only be distributed to the individual whose name appears on the card used to make the deposit and only be paid back to the same card;

(III) Only one account is allowed per person. No winnings may be collected on accounts opened in false names or on multiple accounts opened by the same person;

(IV) Energy may request a CLIENT to provide additional proof of identity or proof of Source of Funds as it deems necessary under the subject of closer scrutiny for regular players or in the case of the level of risk that the business is exposed to is classified as high. Energy may suspend the account until such proof has been provided and accepted as per regulatory standards;

(V) All transactions are screened to prevent any money laundering activity.

c. Any suspicious or fraudulent transactions may be reported further to the relevant authorities, including but not limited to the National Crime Agency (NCA).

21. Intellectual Property

a. All content, trademarks, service marks, trade names, logos and icons are the property of Energy and are protected by copyright laws and international treaties and provisions.

b. The CLIENT agrees not to delete any copyright notices or other indications of protected intellectual property rights from materials that the CLIENT receives from Energy or Energy’s WEBSITES. The CLIENT will not obtain any intellectual property rights in, or any right or license to use such materials or the WEBSITES, other than as set out in this Agreement.

c. The CLIENT agrees not to resell marketing materials provided to them by Energy or permit secured access of the WEBSITE to others, and not to copy any materials appearing on the WEBSITE for resale or for any other purpose to others without the prior written consent of Energy. The same rule applies to all users of the WEBSITE and is not limited to the Account holders only.

d. Images displayed on the WEBSITE are either the property of Energy or are used with the owner's permission. The CLIENT agrees not to upload, post, reproduce or distribute any information, software or other material protected by copyright or any other intellectual property rights (as well as rights of publicity and privacy) without first obtaining the permission of the owner of such rights and the prior written consent of Energy.

22. Indemnification

The CLIENT agrees to indemnify Energy and its officers, directors, and employees, and to hold them harmless from and against any and all claims, liabilities, damages, losses, and expenses, including and without limitation to reasonable attorney's fees and costs, arising out of or in any way connected with:
I. A CLIENT's access to or use of the WEBSITE or Services;
II. A CLIENT’s violation of any of the terms of this Agreement; or
III. A CLIENT’s breach of any applicable laws or regulations.

23. Term and Termination

a. The term of the Agreement shall be for an indefinite period of time. Should the CLIENT wish to terminate this Agreement at any time, he/she may do so by sending an email notification to Energy. The CLIENT shall not be able to carry any new transactions, as of the termination date.

b. The CLIENT may only terminate the agreement with Energy by providing written notice to the customer support email at support@energycasino.com.

24. Data processing

Prior and during the CLIENT’s use of Services, it will be necessary for Energy to collect and process the CLIENT’s personal data. All information pertaining to how Energy collects, processes, secures and shares personal data can be found in the Energy Privacy Policy.

25. Responsible Gaming

a. Gambling whilst under the age of 18 is a criminal offense and Energy takes the responsibility of preventing access by under 18s very seriously. Energy may supply the information given by the CLIENT during registration to authorised credit reference agencies, 3rd party identity verification services and/or fraud prevention agencies to confirm the CLIENT’S identity. Such information will be processed in accordance with our Privacy Policy. Electronic age verification checks are carried out and whilst Energy aims to make the process as seamless and unobtrusive as possible, it is possible that further information will have to be obtained directly from the CLIENT. Once identity checks are positively conducted the CLIENT will be allowed to gamble.

b. Energy is committed to ensuring that its CLIENTS gamble in a responsible manner, while acknowledging that gambling can be addictive to some and affect their lives negatively. In view of this, Energy offers various measures to promote responsible gambling practices.

Such measures include: setting limits on deposits, wagers and session times as well as the possibility to self-exclude for both a definite and/or an indefinite period of time. c. Energy will block attempts to play multiple slot games at the same time, as simultaneous play on two or more slots is not permitted. d. The CLIENT is able to lock their Account for a defined or undefined period of time when he/she no longer wishes to gamble, play or stake.

e. Energy offers CLIENTS a “time-out” facility for the following durations: 24 hours, one week, one month or another period the CLIENT may reasonably request, up to a maximum of 6 weeks.

f. Energy further allows the CLIENT to self-exclude themselves from their account for a duration of not less than 6 months, and not more than 12 months. This period may, on request, be extended for one or more further periods of at least 6 months each. Once this change has been made to an account for a set period, it will not be possible for the account to be re-opened for any reason before the set period has expired. During the period of self-exclusion, Energy will apply additional measurements in order to prevent the CLIENT from registering new accounts.

g. At the end of this period chosen by the CLIENT, the self-exclusion remains in place if no specific action is taken by the CLIENT to gamble again.

h. Should the player wish to resume gambling after the self-exclusion period expires, the player must contact customer support to begin the positive return procedure. Once the player's request is received, via email or chat, our customer support agents will provide a phone number and available timeframes to facilitate the call.

i. By accepting our terms and conditions, the CLIENT acknowledges and confirms that they are not already excluded from Energy’s Services. Therefore, no deposits, losses or winnings will be owed/refunded to a CLIENT if they are associated with a fraudulently created additional/duplicate account. To fully investigate such cases Responsible Gambling or Fraud Departments are entitled to request additional forms of documentation, such as ID in hand and phone/voice verification.

j. A cooling off period of 24 hours will be put into effect, should a CLIENT request the raising or removal of limitations or request restrictions of the Account to be made undone. Requests for lower limits or requests for a renewal of the period of exclusion will be actioned immediately.

k. Upon entry into self-exclusion, Energy will automatically refund the remaining account balance.

l. In the case of account closure, the balance will be frozen unless otherwise requested by the CLIENT. Such refunds will incur a 1.35 GBP administrative fee. In addition, all active promotions will be voided.

m. The CLIENT will be removed from any direct marketing lists Energy holds, within two days of a self-exclusion.

n. Any still outstanding bets (where the result is not yet known) at the time of requesting a self-exclusion, will result in the corresponding sums being paid to the CLIENT, after the event has been settled, should the bets result in a win.

o. During the self-exclusion period, every effort will be applied to prevent the CLIENT from creating a duplicate account and any account detected with a clear link to an account under self-exclusion will be closed upon detection and any remaining unused balances will be returned to the original depositing source.

v. Please note, an ‘idle time’ is reached after 40 minutes of inactivity, at which point a CLIENT will be logged out automatically. We recommend that clients do not leave themselves logged in if their device can be potentially accessed by others, especially minors or those with known gambling problems.

w. In the case of protecting vital interests of those affected by problem gambling, who are in a critical situation and are expressing suicidal thoughts to our agents via direct communication, Energy reserves the right to contact the relevant local authorities to seek immediate action.

x. Please be advised that all sensitive data related to problem gambling or exclusions have to be collected and kept on record to carry out our statutory functions related to affected individuals. Thus, in such cases where a CLIENTS’ well-being is at stake, Energy will take all possible steps to maintain full compliance with the Social Responsibility Code, which could in some cases override GDPR where necessary. Energy reserves the right to impose account limitations or account closure should there be any gambling issue recognised in a CLIENTS’ behaviour.

26. INACTIVE ACCOUNTS

a. An “Inactive Account” is an account that has a real-money balance and no bets recorded for twelve (12) consecutive months (365 days).

b. Before your account is labelled Inactive, Energy will contact you via email 30 days in advance. You may reactivate an Inactive Account by logging into that account and placing a bet.

c. Once an account becomes an Inactive Account, Energy will charge five (5) EUR or equivalent in account currency: 5 GBP, 5 USD, 5 CAD, 5 NZD, 25 PLN, 25 BRL, 50 NOK, 400 RUB, 400 INR, 1500 HUF, 1250 JPY, 5000 CLP, 25 SOL, 100 ZAR, 150,000 VND every 30 days as an administrative fee to your account, as long as there is a positive balance.

27. COMPLAINTS

Energy is committed to provide the best quality of support for our players.

One of the ways in which Energy can continue to improve its Services is by listening and responding to the views of CLIENTS and, in particular, by responding positively to complaints. However, admittedly reaching a unanimous outcome in all cases may not always possible.

If a Client wishes to make a complaint or feels that their case might need further escalation, they should contact the Energy customer support service by email at support@energycasino.com. Energy customer care representatives shall acknowledge the receipt of the complaint to the Client within a maximum period of 3 working days.

Energy’s agents are also available on live chat, as Energy strives to ensure that making a complaint is as accessible as possible. The 'Support' section on the WEBSITE is there to assist the CLIENT in selecting the most appropriate communication channel to reach our customer support.

Energy will also accept any complaints received via 3rd party intermediaries/support tools such as the Resolver web tool, however, please be advised that any complaints raised via social media will not be considered as an official complaint.

Please be advised that in order for us to take action on a complaint in the shortest time frame possible, it must contain clear and concise information about the Client’s identity (name, surname, username, registered email and residential address), as well as all relevant details about the case (the name of the game, any available screen-shots the time and date of the incident with a clear explanation).

The customer support managers (and other managers, if necessary) assigned to the escalated case will commit their best efforts to promptly resolve a reported matter internally. The whole process should take no more than 8 weeks to be assessed and responded to. However, please note that when the client fails to respond to any reasonable requests for additional information within 7 days, this may bring the procedure to a halt until a response is received from the Client. The procedure will be resumed from the same point as it was halted as soon as the Client responds to such a request. An informal approach is appropriate when it can be achieved but if concerns cannot be satisfactorily resolved informally, then the formal complaints procedure will be followed.

Energy strives to ensure that all Clients are informed of any final decision through a letter of deadlock. However, if a Client is dissatisfied with said final decision or if a resolution has not been acheived to their satisfaction within eight weeks of Energy receiving their complaint, then information will be provided about the necessary steps to take an official complaint to a registered Alternative Dispute Resolution Body, also known as an ‘ADR’. An ‘ADR’ is an independent third party, which mediates disputes and assess all of the facts and information provided by both parties and thereafter issues an impartial decision on the matter. The Independent Betting Adjudication Service (IBAS) is the approved entity for complaints relating to Energy for the purposes of the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and information) Regulations 2015.

Please note that IBAS will only adjudicate on a dispute if:

• the dispute has occurred within the last 12 months;

• the operator holds a license issued by the Gambling Commission and the dispute concerns a bet or a term/condition which is subject to the laws of England, Wales or Scotland;

• a genuine letter of deadlock exists between the CLIENT and Energy;

• the same dispute has not been previously considered or dealt with by a court or another ADR.

• the matter is not related to terms and conditions of multi operator self - exclusion scheme (GamStop).

• the customer is not disputing that Energy should have independently intervened in preventing any harm that may arise while the customer is spending his/her money.
